IMMEDIATE ATTENTION REQUIRED FOR YOUR DRIVING PRIVILEGE: While court dates are often 30-60 days away… immediate action is required to address the DMV suspension of your license. If your license was taken away or you were given a pink sheet, Temporary License and Notice of Suspension, the DMV should be contacted within 10 days of your arrest in order to delay and challenge any suspension. Failure to do so, will waive your right to a hearing to challenge the suspension, which becomes automatic 30 days after arrest. By setting that hearing, your license will continue to be valid for 60 days or until suspended after the hearing. While there can be many issues in a Drunk Driving case, and while all cases are factually unique – here is a brief list of possible issues:
ARREST: The officer must have a lawful reason to contact you and prove you were driving. There may be issues concerning driving, the stop, detention, and any search
TESTING: A field breath test, a Breath or Blood Test at the station, as well as field sobriety tests are administered. There may be issues with the way the tests were conducted, time of tests, individual factors, calibration and maintenance of any testing equipment.
